Careless Spam Complaint

Please see this topic from 2007, especially the part where Dynadot Staff says they would modify the wording of their emails.  I just found it interesting that they still haven't in 2012.

Today I received this email above warning me.  A copy of the spam complaint was not sent with it, so of course I'm completely unaware what they are referring to.

I've been a Dynadot customer for several years.  I spend over $5,000 with them each year.  The domain in question belongs to me, is hosted elsewhere and doesn't send email.  It doesn't even use Dynadot's nameservers.  The only tie to Dynadot is the domain registration, which I will likely transfer away.

What other choice do I have?  I have 100s of domain names with Dynadot, and can't risk this type of heavy handed response to a fake complaint, or a joe job, or other.  What would you do?

I don't believe that anyone was intending to imply that your domain had engaged in any of the activated listed,  just that breaking US law is not the only way to violate our Service Agreement.  

We do not disable domains without cause.  We do our best to treat all complaints fairly and to get to the truth of the matter.

Dynadot has speculated a lot of illegal activity in their latest response.  I want it to be very clear that none of this pertains to the domain in question.  The domain is DARKSITES.COM which is a gothic/horror directory of sites about topics like horror, gothic, vampire, werewolves, etc....

There is none of the above related to this complaint.

You're more than welcome to take a look and see that it is merely a directory of recommended sites.  There is nothing for sale, there is nothing illegal, and there is nothing regarding spam related to the domain.

Violation of US law is not the only thing we disallow when it comes to our web hosting services.  As stated on our website:

Limitations
Our web hosting is provided for you to store files belonging to your website. It is not intended to be used as file storage. The following activities are prohibited:
SPAM (including spam websites)
Adult content
Copyright Infringement
Trademark Infringement
IRC (connections, servers/hosts, bots, etc.)
System monitoring. You may not engage in probes, port-scans, sweeps, or spoofing.
Any illegal content prohibited by US law including:
child pornography
bestiality
child erotica
gambling
pyramid or "multilevel marketing" schemes
Anything that threatens the stability/network stability of our web hosting.

Further restrictions are stated in our Service Agreement, Part 1, Section 7.

I'm with you apimaster. I've transferred several domains away from Dynadot after they claimed I got "too many spam complaints" -- even though the ratio of complaints to the number of emails being sent was less than half of what's allowed under US LAW.

So Dynadot feels it has the right to enforce rules that don't even exist under law.

I'm now registering any domains where I need to have email sent from a different registrar that actually respects US Law rather than their own.

No resolution.  Dynadot hasn't proved that they received several spam complaints.  I think they probably didn't receive several, but instead only received 1 complaint.

They only sent me some text from an email with no headers or anything to prove it came from my domain name, my servers, or anything.  I think they realize that I wasn't responsible but didn't want to admit it or apologize for it.

This is how you lose innocent customers spending thousands of dollars with you every year.

The wording of our email is "we may have to disable your account."  We do not simply disable a domain based on one complaint or without investigation.  

As for your specific case,  please refer to our email correspondence.  We'd prefer not to discuss the matter in a public forum.
